SUMMARY: Currently, often with the best intentions to keep a child or self-safe from an abusive partner, a parent convicted of kidnapping a child is labeled a sex offender because of the kidnapping. This bill would modify the law to make sure there was a sex crime that took place before someone who is convicted of kidnapping has to register as a sex offender.


An Act relative to kidnapping as a sexual offense

SECTION 1. Section 178C of chapter 6 of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by striking out in line 72 the words, “kidnapping of a child under section 26 of said chapter 265;”, and further by striking out in lines 112 to 113, inclusive, the words, “kidnapping of a child under the age of 16 under section 26 of said chapter 265;”

SECTION 2. Section 178E of said chapter 6, as appearing in the 2014 Official Edition, is hereby amended by inserting before the words, “ or if the sex offender”, in line 166, the following clause:- has been convicted of a kidnapping under section 26 of chapter 265 that included an element that was sexual in nature
